Service overview

What this service is

Application filing with class selection and tracking. Delivered end-to-end by Bluman's Chartered Accountants with a fixed scope and a published price.

Who needs it

Businesses and individuals who want exclusive rights over a brand name, logo, tagline or device in India — typically before a launch, a funding round, or a marketplace or platform listing that asks for brand ownership proof.

What Bluman will do

  • Identify the correct class or classes under the NICE classification for the goods and services you actually supply, since protection is class-specific.
  • Run a search of the trade marks register, including phonetic and device variants, and tell you honestly where the conflict risk sits.
  • Draft the specification of goods and services — too narrow leaves gaps, too wide invites objection.
  • Verify the applicant details and the date of first use, and prepare Form TM-A along with the authorisation in Form TM-48.
  • File the application and confirm the application number and the right to use the ™ symbol.
  • Monitor status through examination and tell you what the examination report requires; the objection reply itself is a separate service.

Key deliverables

  • Search report with a class recommendation and a conflict-risk view
  • Filed TM-A with the application number and filing receipt
  • Confirmation of ™ usage rights from the filing date
  • Status update at examination with an explanation of what it means

Filing is completed within the stated turnaround once the mark and applicant documents are ready. Registration in India ordinarily takes many months and depends on examination, publication in the Trade Marks Journal and the four-month opposition period.

  • · Government fees, portal charges and applicable taxes are billed at actuals.
  • · Timelines start once complete documents and information are received.
  • · Outcomes that depend on a government authority cannot be guaranteed, but every step is tracked and communicated.

Forms and filings involved

  • Form TM-A

Application for registration of a trade mark.

  • Form TM-48

Authorisation of agent to act on the applicant's behalf.

  • Examination report

Issued by the registry; where objections are raised, a reply must be filed within the prescribed period.

Documents required

  • Logo or wordmark file in the exact form to be registered
  • Applicant details — PAN and address; incorporation certificate for a company or LLP
  • Udyam or MSME certificate, where applicable for the reduced government fee
  • Description of goods and services
  • Date of first use with evidence, if the mark is already in use
  • Signed Form TM-48 authorisation

What we need from you

  • Provide the final artwork — a mark cannot be materially altered after filing.
  • Confirm the date of first use accurately; an unsupported claim weakens the application.
  • Respond promptly if an examination report is issued, as the reply period is fixed.

Important conditions

  • Bluman prepares and files the application and tracks it. Registration is granted by the Trade Marks Registry; no registration can be guaranteed.
  • Government filing fees are charged per class per applicant and are payable at actuals.
  • Objection replies, hearings, opposition proceedings and renewals are separate services.
